Welcome to ashliferguson.com ("Site"), operated by Ashli Ferguson ("I," "me," or "my"). By accessing or using this Site, including purchasing any digital products from the template shop, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Site.
1. Overview
This Site serves as a personal portfolio and hosts a digital template shop offering downloadable creative assets, including but not limited to After Effects templates, motion design files, and other digital products ("Products"). These Terms govern your use of the Site and any purchases made through it.
2. Eligibility
By using this Site and purchasing Products, you represent that you are at least 18 years of age or have the consent of a legal guardian, and that you have the legal capacity to enter into a binding agreement.
3. Digital Products & Licensing
3.1 License Grant
Upon completing a purchase, you are granted a non-exclusive, non-transferable, single-user license to use the purchased Product for personal and commercial projects, subject to the restrictions below.
3.2 Permitted Uses
Use in personal or client projects (e.g., creating videos, social media content, presentations, or motion graphics using the template as a starting point).
Modify and customize the template for your own work.
3.3 Restricted Uses
You may not:
Resell, redistribute, sublicense, or share the Product files (whether modified or unmodified) as a standalone template, asset pack, or digital product.
Claim the original template design as your own work.
Include the Product files in any competing template marketplace, library, or giveaway.
Use the Product in connection with any unlawful, defamatory, or harmful purpose.
3.4 Extended or Team Licensing
The standard license covers a single user. If you need a multi-seat or extended license for teams, agencies, or enterprise use, please contact me directly at hello@ashliferguson.com.
4. Purchases & Payment
All prices are listed in U.S. dollars unless otherwise stated.
Payment is processed through the Site's integrated payment provider (e.g., Squarespace Commerce / Stripe). I do not store your payment information directly.
You agree to provide accurate and complete payment details. You are responsible for any applicable taxes.
5. Delivery
All Products are delivered digitally. Upon successful payment, you will receive access to download your purchased Product via email confirmation and/or an on-site download link. Delivery is typically instant, but may take up to 24 hours depending on payment processing.
6. Refund Policy
Due to the digital nature of the Products, all sales are final. Refunds are generally not offered once a Product has been downloaded or the download link has been made available.
Exceptions may be considered on a case-by-case basis in the event of:
A duplicate purchase (same Product purchased twice by the same buyer).
A technical issue that prevents the Product from functioning as described, and the issue cannot be resolved through troubleshooting support.
To request a refund exception, contact me at hello@ashliferguson.com within 14 days of purchase.
7. Intellectual Property
All content on this Site — including but not limited to text, graphics, logos, images, templates, code, and design elements — is owned by Ashli Ferguson and is protected by applicable copyright and intellectual property laws.
Purchasing a Product does not transfer ownership of the underlying design or intellectual property. You receive only the license described in Section 3.
8. Site Content & Portfolio
The portfolio, case studies, and other non-shop content on this Site are provided for informational and showcase purposes. You may not reproduce, distribute, or use any portfolio content without my prior written consent.
9. User Conduct
You agree not to:
Attempt to gain unauthorized access to any part of the Site or its systems.
Use the Site in any way that could damage, disable, or impair its functionality.
Use automated tools (bots, scrapers, etc.) to access the Site or its content.
10. Disclaimer of Warranties
The Site and all Products are provided "as is" and "as available" without warranties of any kind, whether express or implied. I do not guarantee that:
The Site will be available without interruption or error.
Products will be compatible with every version of third-party software (e.g., specific versions of Adobe After Effects).
It is your responsibility to ensure compatibility with your software and system before purchasing.
11. Limitation of Liability
To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any Product, even if advised of the possibility of such damages. My total liability for any claim shall not exceed the amount you paid for the specific Product giving rise to the claim.

The Site may contain links to third-party websites or services. I am not responsible for the content, privacy practices, or terms of any third-party sites. Accessing them is at your own risk.
13. Changes to These Terms
I reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
